FLORIDA, NEW YORK, AND TEXAS 
CERTIFIED TERRORISM LOSS MANUAL RULES SUPPLEMENT AVAILABLE

Reference Bulletin: 02-0550 and 03-0092

Manual rules that address the use of only the Certified Terrorism Loss endorsements described in Reference Bulletins 02-0550 and 03-0092 have been filed and are available for use, effective immediately, in the states of Florida, New York, and Texas.

BACKGROUND

The sample Rule Supplements that are shown on our public web site as attachments to Bulletin 02-0550 contain both certified and non-certified terrorism rules. As a result, special abridged supplements, that contain rules pertaining only to the AAIS certified terrorism filings were developed for use in those states where non-certified filings were not made (specifically, Florida, New York, and Texas).

COMPANY ACTION

Florida

Companies that have granted AAIS filing authority for rules can adopt the manual supplement without notifying the insurance department if they intend to use it without change.

However, companies that choose to depart from the AAIS filed rules, including a decision not to adopt the manual supplement, must notify the insurance department in writing as soon as possible. Commercial Inland Marine is deregulated. Therefore, no notification to the state is required with respect to this line of insurance.

New York

Companies that have granted AAIS filing authority for rules are required to notify the insurance department as soon as possible as to whether or not they intend to adopt this filing.

In accordance with filing procedures recently established by the insurance department, companies that choose not to adopt a rules filing or that choose to delay adoption of the filing must:

--    state the reason(s) for the non-adoption/delay in their notification letter; and
--   submit a copy of the rules currently in use for the coverage.

Companies that intend to adopt the rules contained in this filing must file the necessary state filing form and designate the effective date for the revised rules.

Texas

Affiliated companies can adopt the rules supplement by establishing an effective date and submitting the necessary reference filing(s) to the Texas Department of Insurance.

However, due to special Texas guidelines, the AAIS rules supplement was placed on file for the Farmowners program, with respect to commercial farm risks only (i.e., filed as commercial multi-peril & used when form GL-610 is attached). Companies will need to file a separate adoption if they also wish to use the rules supplement when writing personal farm risks (when form GL-2 is attached).

AVAILABILITY

All future manual orders in the aforementioned programs and states will include the certified only Rules Supplement pages.
