A special 01 03 edition of each Non-Certified Act of Terrorism Exclusion endorsement is now available for use in Washington.

BACKGROUND

Due to the fact that the state of Washington does not allow forms or endorsements to contain anti-concurrent causation provisions, the following sentence, which appears in the multistate 12 02 endorsement editions, is omitted from the 01 03 endorsement editions:

Such loss or damage is excluded regardless of any other cause or event that contributes concurrently or in any sequence to the loss.

 
ENDORSEMENTS

A table which identifies the two types of exclusion endorsements that apply to each program filed in Washington is shown below:

COMPANY ACTION

The endorsements described in this bulletin have been placed on file as shown below. Refer to the following filing numbers in all correspondence directed to the insurance department.

Endorsements Filed On Behalf Of Affiliated Companies

Endorsements (Agricultural Output, Commercial Inland Marine, Commercial Liability, Commercial Output, Commercial Output - XL, Contractors & Developers Output, Crime, Glass, and Personal & Premises Liability)

Companies that have granted AAIS filing authority for forms and endorsements can adopt the endorsements without notifying the insurance department.

Rules (Agricultural Output, Commercial Inland Marine, Commercial Liability, Commercial Output, Commercial Output - XL, Contractors & Developers Output, Crime, Glass, and Personal & Premises Liability)

Companies that have granted AAIS filing authority for rules can adopt the manual supplement without notifying the insurance department if they intend to use it without change.

However, companies that choose to depart from the AAIS filed rules must notify the insurance department in writing as soon as possible.

Endorsements Filed On An Advisory Basis

* Since companies must submit their own independent filings before they are able to use any of the advisory endorsements, the effective date that was initially proposed for the filing was not advanced.

Endorsements (Artisans, Businessowners, Commercial Properties, Farm Properties, and Farmowners)

The endorsements for these lines of insurance have been filed with the Washington Department of Insurance. However, AAIS cannot file on behalf of companies in Washington and companies cannot adopt AAIS forms and endorsements by reference. All companies must take independent filing action with the Washington Department of Insurance within 30 days of the company's chosen effective date.

Rules (Artisans, Businessowners, Commercial Properties, Farm Properties, and Farmowners)

The rules for these lines of insurance have been filed with the Washington Department of Insurance. However, AAIS cannot file on behalf of companies in Washington and companies cannot adopt AAIS manual rules by reference. All companies must take independent filing action with the Washington Department of Insurance within 30 days of the company's chosen effective date.

Endorsements  (Commercial Umbrella and Farm Umbrella)

The endorsements for these lines of insurance have been filed with the Washington Department of Insurance. However, AAIS cannot file on behalf of companies in Washington and companies cannot adopt AAIS forms and endorsements by reference. All companies must take independent filing action with the Washington Department of Insurance within 30 days of the company's chosen effective date.

Inland Marine Guide

Endorsements

In Washington, companies are required to file endorsements for non-filed inland marine classes. Companies affiliated for the Inland Marine Guide must make an independent filing, for all Inland Marine Guide classes except Yacht, before they are able to use the non-certified terrorism endorsements (CL 0630 01 03 and  CL 0650 01 03).

Rules/Rating Information

Companies are not required to file rating information or rules for non-filed inland marine classes in Washington.

The forms and endorsements approved for use in this state have been released to Uniform Information Services, Inc. (UIS), the print vendor for AAIS forms and endorsements.
