WASHINGTON At the request of the Washington Insurance Department, the endorsements that were filed to exclude loss caused by certified acts of terrorism have been withdrawn and replaced. A special 01 03 edition of each Certified Act of Terrorism Exclusion endorsement is now available for use in Washington. CHANGES The state of Washington does not allow the anti-concurrent causation provisions found in the endorsements originally submitted to exclude loss caused by certified acts of terrorism. Accordingly, the following sentence was omitted from the 01 03 edition endorsements:
ENDORSEMENTS A table which identifies the exclusion endorsement that applies to each program filed in Washington is shown below:
Endorsements that can be used to cover loss caused by certified acts of terrorism have not been revised. EFFECTIVE DATE AND FILING NUMBERS The endorsements described in this bulletin (and the multistate 12 02 Certified Terrorism Loss endorsements described in Reference Bulletin 02-0550) have been placed on file, under the applicable Filing Status shown below, effective December 23, 2002. Refer to the following filing numbers in all correspondence directed to the insurance department.
COMPANY ACTION Forms and Endorsements Endorsements (Agricultural Output, Commercial Inland Marine, Commercial Liability, Commercial Output, Contractors & Developers Output, Crime, Glass, and Personal & Premises Liability) Companies that have granted AAIS filing authority for forms and endorsements can adopt the endorsements without notifying the insurance department. Endorsements (Artisans, Businessowners, Commercial Properties, Farm Properties, and Farmowners) The endorsements for these lines of insurance have been filed with the Washington Department of Insurance. However, AAIS cannot file on behalf of companies in Washington and companies cannot adopt AAIS forms and endorsements by reference. All companies must take independent filing action with the Washington Department of Insurance within 30 days of the company's chosen effective date. Expedited Filing Transmittal Not applicable in this state. Use normal filing procedures and insert the word "TERRORISM" in the filing description area of the filing transmittal. Inland Marine Guide Companies are required to file endorsements for non-filed inland marine classes. Companies affiliated for the Inland Marine Guide must make an independent filing to use the certified terrorism endorsements (CL 0600 12 02 and CL 0610 01 03) for all Inland Marine Guide classes except Yacht. For companies that have already filed and received an objection related to CL 0610 12 02, it is recommended that CL 0610 01 03 be submitted as a replacement when responding to the Department of Insurance. Companies are advised to refer to the WA DOI website for the filing requirements that apply to terrorism-related filings in Washington.
