ALASKA A special 01 03 edition of each Certified Act of Terrorism Exclusion endorsement is available for use in Alaska. BACKGROUND On January 10, 2003, AAIS filed special editions of the Certified Terrorism Exclusion endorsements in Alaska. At that time, we posted the endorsement numbers and edition dates of the new endorsements on our Alaska terrorism web site, but copies of the endorsements were not released. Since then, our endorsement filings have been officially received by the Alaska Division of Insurance, and individual state filing numbers have been assigned to the two endorsements (coverage endorsement and exclusion endorsement) that apply to each program. (See Page 2 for each program's state filing number.) As the Alaska Division of Insurance has thus far not expressed any concerns with respect to our 01 03 exclusion endorsements, a paper copy of each endorsement is being released as an attachment to this bulletin, and an electronic copy of each endorsement is being posted in conjunction with this bulletin at our public web site (www.AAISonline.com). The 01 03 exclusion endorsements differ from the multistate 12 02 exclusion endorsements in that they contain no anti-concurrent causation references. ENDORSEMENTS A table which identifies the exclusion endorsement that applies to each Commercial Lines program filed in Alaska appears below:
FILING NUMBERS The endorsements described in this bulletin (and the multistate 12 02 Certified Terrorism Loss endorsements described in Reference Bulletin 02-0550), were submitted by AAIS on a File and Use basis, on January 10, 2003. Refer to the following filing numbers in all correspondence directed to the insurance department.
COMPANY ACTION Endorsements All Programs Referenced Above Except Umbrellas Companies that have granted AAIS filing authority for forms and endorsements can adopt the endorsements without notifying the insurance department. Companies that choose not to adopt a filing must notify the insurance department as soon as possible. Companies that have not given AAIS filing authorization for forms and endorsements will need to designate an effective date, complete an AK Expedited Filing Transmittal Document For Terrorism Risk Insurance Forms and Pricing, and submit a filing to the state. Commercial Umbrella and Farm Umbrella Programs Only Each company that wishes to adopt these endorsements must do so by establishing an effective date and notifying the Insurance Department in writing. Expedited Filing Transmittal An AK Expedited Filing Transmittal Document For Terrorism Risk Insurance Forms and Pricing must be included with any filing that is submitted. A copy of this state-specific transmittal form was attached to Alaska Bulletin B 02-20. Inland Marine Guide Alaska does not require that endorsements applicable to non-filed Inland Marine Classes be filed. However, companies are advised to use the same endorsement that is shown for the filed Commercial Inland Marine classes, for all Inland Marine Guide classes except Yacht.
