Regarding "certified" commercial losses
For an act of terrorism to be certified by the U.S. Secretary of the Treasury (and thus trigger coverage under the federal Terrorism Reinsurance Program), it must cause more than $5 million in losses and be inspired, directed, and/or carried out on behalf of a foreign person or interest.

Endorsements

Companies that have granted AAIS filing authority for forms and endorsements can adopt these endorsements on the effective date designated by AAIS without notifying the insurance department. Companies cannot adopt the endorsement earlier than the AAIS effective date.

Rules

Companies that have granted AAIS filing authority for rules for this line of insurance are required to notify the insurance department as soon as possible as to whether or not they intend to adopt the manual supplement.

In accordance with  filing procedures recently established by the insurance department, companies that choose not to adopt the supplement or that choose to delay its adoption must:

-- state the reason(s) for the non-adoption/delay in their notification letter; and
-- submit a copy of the rules currently in use for this coverage.

Companies that intend to adopt the manual supplement must file the necessary state filing form and designate an effective date for the supplement.

Rating Information

Companies that have granted AAIS filing authority for rating information are required to notify the insurance department as soon as possible as to whether or not they intend to adopt this filing.

Regarding "non-certified" commercial losses
Non-certified terrorism losses are all commercial losses from acts of terrorism that are not certified as such by the Secretary of the Treasury, and thus not covered by the federal reinsurance program. These include, but are not necessarily limited to, acts inspired, directed, and/or carried out by domestic U.S. groups or individuals.

Filing of non-certified materials is not anticipated in this state.
