Terrorism Risk Insurance Act of 2002
and related state regulatory policies Regarding
"certified" commercial losses
For an act of terrorism to be certified by the U.S. Secretary of the Treasury (and thus
trigger coverage under the federal Terrorism Reinsurance Program), it must cause more than
$5 million in losses and be inspired, directed, and/or carried out on behalf of a foreign
person or interest.

UPDATE:
As part of their terrorism specific requirements,
California is requiring that a rate filing be made any time that a certified terrorism
form filing is submitted. Even if the company intends not to charge anything, the
California Department of Insurance (CDI) has indicated a rate filing still must be made to
justify not making a charge.
This information was originally not published by the state.
AAIS became aware of it only after our filings were submitted. These requirements are now
published.
In addition to what is in CA Bulletin 2002-9, companies

Regarding "non-certified" commercial losses
Non-certified terrorism losses are all commercial losses from acts of terrorism that are
not certified as such by the Secretary of the Treasury, and thus not covered by the
federal reinsurance program. These include, but are not necessarily limited to, acts
inspired, directed, and/or carried out by domestic U.S. groups or individuals.
