Status of Non-Certified Terrorism Loss Filings
AAIS optional endorsements that restate the war exclusion and that exclude loss resulting from non-certified acts of terrorism, subject to certain exceptions, have been approved for use in the following states:

Nevada, New Mexico, North Carolina, North Dakota, South Carolina, South Dakota, Ohio, and West Virginia

These endorsements become effective as of April 1, 2003 for all states listed above, except North Carolina and Ohio. The effective date for North Carolina is May 1, 2003. The effective date for Ohio (in which filings were submitted on a file and use basis) is February 19, 2003.

The state-specific information posted at the AAIS public Web site has been updated to reflect the endorsement numbers approved for each state; provide AAIS filing numbers, and, when applicable, state-assigned filing numbers; and specify the company action needed to adopt the filing.

The endorsements described above were filed to replace the counterpart War, Military Action, and Terrorism Exclusion endorsements that were filed in early 2002. The forms and endorsements listings for all affected lines of insurance are being updated to reflect the most current terrorism endorsements.

Endorsement CL 0605

Manual Supplement - Rules and Rating Information
Rules that govern the use of the endorsements that address both certified and non-certified terrorism loss have also been approved for the states listed above. The rules have been or are being modified slightly to include reference to endorsement CL 0605, which was filed to satisfy the "separate line item" terrorism disclosure notice requirement that became mandatory on February 25, 2003.

Once the modified rules are approved, the manuals posted at the AAIS subscriber Web site, AAISdirect.com, will include a Terrorism Supplement that combines the rules that address the various terrorism endorsements with the terrorism rating information currently posted at the AAIS open Web site. Orders for AAIS manuals will also be filled to include the Terrorism Supplement, once the modified rules are approved.

Additional Filings
The state-specific information posted at the AAIS public Web site is in the process of being updated to reflect the filing of the non-certified terrorism endorsements in the following states:

Alabama, Alaska, Arizona, Arkansas, Colorado, District of Columbia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, New Hampshire, New Jersey, Oregon, Pennsylvania, Puerto Rico, Rhode Island, Vermont, Wisconsin, and Wyoming.

The proposed effective date is April 1, 2003. Endorsement numbers, filing numbers, and the company action needed to adopt the endorsements will be posted once Insurance Department approval has been received.
