Georgia Filing Action for Certified
Terrorism Loss
AAIS endorsements that can be used to cover or exclude certified
terrorism loss and the corresponding rating information have been
filed in Georgia, on a file and use basis. The endorsement numbers
and corresponding rating factors have been posted on the AAIS open
Web site at http://www.aaisonline.com/terror/StateAction.htm.
Many of the endorsements filed in Georgia reflect an edition date
of 02 03 rather than the multistate edition of 12 02. Under the 02
03 endorsements, fire-following losses are not subject to the
Maximum Annual Liability amount set forth in the Federal Terrorism
Risk Insurance Act of 2002. A copy of each 02 03 endorsement will
be distributed, by bulletin, to Georgia affiliates in the near
future. Starting January 31, 2003, AAISDirect subscribers will
have access to the state-specific endorsements electronically.
Up until now, Georgia has not
approved terrorism exclusions. As a result, the endorsements that
cover loss caused by certified acts of terrorism are intended for
use with new, renewal, and in-force policies, but the rating
factors should be used only with new and renewal policies.
The Department of Insurance has
indicated that their current position with respect to
non-certified loss exclusions (that of not permitting them to be
placed on file) will remain unchanged. As a result, AAIS will not
be making a filing of any non-certified exclusion endorsements in
this state. Accordingly, the portion of the web site devoted to
non-certified terrorism loss has been deleted from the
Georgia-specific web pages.
